JOHN BAILEY OF COMBS CHAPEL EN LE FRITH DERBYSHIRE

(Written 10th September 1878 Proved 4th September 1879

I JOHN BAILEY of Combs in the Parish of Chapel en le Frith in the city of Derby Innkeeper declare this to be my last Will and Testament and I APPOINT my nephew ISAAC BAILEY of Stockport in the city of Chester Doctor of Medicine and my sons ROBERT BAILEY and ALBERT BAILEY Executors and Trustees thereof and I declare that whenever the said word Trustees shall hereafter recur or be used it shall be deemed and taken to include and refer to the said ISAAC BAILEY ROBERT BAILEY and ALBERT BAILEY and the survivors and survivor of them and executors or administrators of the survivor I GIVE DEVISE AND BEQUEATH to my said Trustees all my real and personal estates and effects whatsoever and whenever the same may be found at my decease UPON TRUST that they my said Trustees do in the first place pay and discharge all my just and lawful debts and funeral and testamentary expenses and after payment thereof UPON TRUST that they my said Trustees permit and suffer my wife SARAH BAILEY to use such part of my personal estate as shall not consist of my money and also to receive the rents interest income and benefit arising from all my real and personal estates for and the term of her natural life if she shall so long continue unmarried my widow and from and immediately after the decease or marriage of my said wife whichever shall first happen I DIRECT and empower my said Trustees to sell and convert the whole of my real and personal estates and effects into money and to convey the whole of my real estate to the purchaser or purchasers thereof and that the receipt or receipts of any  said Trustees for the purchase money arising from the sale of my real estate shall effectually discharge the person or persons paying the same from further responsibility in respect of such money and after such sale or sales shall be made as aforesaid UPON TRUST that they my said Trustees shall after paying the expenses connected with the sales and of making out a title to my real estate stand possessed of the monies arising from such sales UPON TRUST to pay and divide the same monies unto and equally between and amongst all my children namely WILLIAM ROBERT JOHN ALBERT MARK and HANNAH and I DECLARE that if any of my said children shall die before he or she shall be entitled to receive any benefit under this my will leaving issue surviving that then and in each such case such issue shall take the share of the child so dying if more than one such issue in equal shares and I DECLARE that my said Trustees shall be  responsible only each for his own debts receipt neglects and defaults only and not one of them for the other or either of them

This is the Last Will and Testament of me Ann BARBER Spinster of Chapel en le Frith in the County of Derby being of sound disposing mind memory and understanding made in manner and form following First I order and direct that all my Just debts Funeral and other inevitable expenses be paid and fully discharged by my Executors out of my personal property  And it is my mind and will and I order and direct that the House or Houses part of which I now reside in situate in Chapel en le Frith aforesaid with all rights privileges and appurtenances thereto belonging or in any wise appertaining be sold as soon as convenient after my decease for the best price that can or may be had and obtained by my Executors herein hereafter mentioned or the survivor of them and I do hereby Will and Declare that the conveyance or conveyances assurance or assurances to be made and executed by my Executors or the survivor of them shall be a good and effectual conveyance or conveyances assurance or assurances to the person or persons purchasing the same his her or their assigns and that the Receipt or Receipts of my Executors or the survivor of them shall be sufficient discharge to the purchaser or purchasers his her or their assigns for the purchase money and that the purchaser or purchasers shall not in any wise be answerable for the application or none application of the purchase money. And it is my mind and will and I order and direct that the money arising from such sale together with my personal property after the payment of my Just Debts Funeral and other expenses be disposed of in the following manner (that is to say) I give and Bequeath unto Amelia the wife of James ESDAILE Esq. of Bunhill Roise? London the sum of Fifty pounds as a gratuity to buy her mourning I also give her my Portrait.  I Give and Bequeath unto my Cousins Thomas BARBER, William BARBER, John BARBER, Sarah JOULE, Ellen HOLDGATE widow, the children of Eli ATKIN Deceased, and the children of Edward ATKIN Deceased the sum of one Hundred Pounds to be paid Twelve months after my Decease and to be equally divided into seven equal parts one seventh part to be given and equally divided amongst the children of Eli ATKIN Deceased share and share alike and the children of Edward ATKIN to have another seventh part equally divided amongst them share and share alike.  I Give and Bequeath unto Mrs BROWN of Disley one mourning ring to be ordered after my decease and to be engraved with my name I also give unto her my best worked Apron.  I Give and Bequeath unto the Sunday School carried on under the establishment at Chapel en le Frith the sum of Ten pounds to be Lodged in the hands of Mr Josiah BRADBURY of Rye Flatt and him or his heirs Executors Administrators or Assigns to pay the Interest yearly and every year to the above mentioned institution.  I order and direct that the sum of Ten pounds be left in the hands of Mr Josiah BRADBURY to keep my Family Vault in Repair with painting and other necessaries that it may from time to time stand in need of.  I Give and Bequeath unto James BENNETT of Ashton Clough the sum of Five Pounds in order to see that my Family Vault be kept in good repair.  I Give and Bequeath unto Mr Robert COLLYER Sen. of Upperfold the sum of Five Pounds as a gratuity for his kindness unto me.  I Give and Bequeath unto Mrs SHEPHERD of Moor Oaks near Sheffield and Mrs BRADBURY of Rye Flatt my mourning rings.  I Give and Bequeath unto Sarah HADFIELD the Daughter of my Aunt Betty CARRINGTON Deceased my common wearing Apparel likewise one Oak Sett of Drawers.  I Give and Bequeath unto all my First Cousins by my Mothers side all my Table Linnen Bed Linnen Bedding Books together with all the remainder of my Wearing Apparel to be equally divided amongst them share and share alike Mrs SHEPHERD Mrs KERSHAW and Mrs BRADBURY of Rye Flatt to have their First choice.   All the rest and residue of my property of whatsoever the same may consist of or wheresoever the same lie or be and not herein before efectually disposed of I Give and Bequeath unto my First Cousins by my Mothers Side as their property to be equally divided amongst them share and share alike and it is my Mind and I order and Direct that the Children of Elisebeth the Deceased daughter of my Aunt Betty CARRINGTON Deceased shall have their Mothers share equally divided amongst them as the shall severally attain the Age of Twenty one years.  I order and Direct that Mary BARBER the Widow of my Dear Brother William BARBER and the Revd E GLOSSOP have no interference in any matter relating to either my personal or Real Estate or in any wise appertaining thereunto.  Lastly I do hereby nominate constitute and appoint Mr Josiah BRADBURY of Rye Flatt and Mr William CARRINGTON of Cale Green near Stockport Hatter Executors of this my last Will and Testament and Mr George SHEPHERD of Moor Oaks near Sheffield Trustee to see the due execution of this my Last Will and Testament And hereby revoking all other Will or Wills by me heretofore made I declare this to be my last Will and Testament In Witness whereof I have hereunto set my Hand and Seal this Fourteenth day of June in the year of our Lord One Thousand Eight Hundred and Twenty

Appeared Personally William BARBER of the Parish of Chapel en le Frith in the County of Derby Gentleman the party applying for Letters of Administration of the Estate and Effects of the said Mary BARBER late of Chapel en le Frith in the County of Derby aforesaid Widow Deceased, and made Oath, that the Estate and Effects of the said deceased, for, or in respect of which, the said Letters of Administration are to be granted, exclusive of what the said deceased may have been possessed of, or entitled to, as a  Trustee for any other person or persons, and not beneficially, but including the Leasehold estate or Estates for Years of the deceased, if any, whether absolute or determinable on Lives, and without deducting any thing on account of the Debts, due and opwing from the said deceased, are under the value of Twenty Pounds, to the best of this Deponent`s knowledge, information and belief.

On which day appeared personally William BARBER and suggested that Mary BARBER late of the parish of Chapel en le Frith in the County of Derby and within the Jurisdiction of the Dean and Chapter of the Cathedral Church of Lichfield Widow deceased died upwards of fourteen days ago intestate and that he is the natural and lawful son of the said deceased and the person entitled to Letters of Administration of her Goods and personal Estate Wherefore he prayed the same to be granted to him which the Surrogate decreed accordingly.

In the name of God Amen. this Third day of October in the yeare of our Lord 1687.  (Latin phrase) I Thomas BARBER of Hurdlow in the County of Derby husbandman indisposed in health but of sound & pfect Memory doe make & ordain this my last Will & Testamt in manner & form following.  First I comend my soul into the Hands of Almighty God trusting in & through the merits of Jesus Christ my saviour to inherit Everlasting Glory in the Kingdom of Heaven.  My Body I give to the Earth from whence it came to be bauried in my Seat in the parish Church of Chapell in Lee Firth & as touchinge my Worldly Estate I dispose thereof as followeth

Thomas BARBER of Malcoffe: 1720

In the name of God Amen This tenth day of December Anno Domini 1718 I Thomas BARBER of Malcoffe in the parrish of Chappel in le Frith in the County of Derby yeom. Being weakly as to my Body but of sound mind and perfect memory Praise be therefore given to Allmighty God for the same And calling to mind the certainty of Death and the uncertainty of the time when it shall please God to take me out of this state do make and ordaine this my present last Will and Testament in manner and form following First I committ my Soul into the hands of Allmighty God trusting in his mercy and in the meritts of my Redeemer Jesus Christ for the pardon and forgiveness of all my sins and for Eternal life and my Body to the Earth from whence it came to be decently interred att the discretion of my Executors hereafter named.  And for such worldly Goods and Estate, as God of his great mercy far above my defects hath given unto me I give and dispose of the same as followeth. Imprimis My Will and mind is that all my due debts funerall expences and charges about the Probate of this my last Will & Testament be first paid and discharged forth of my Household goods other then what shall be mentioned to be given to my loveing wife: or to my Grandson Thomas BARBER excepting likewise my Books.  Item I give and Bequeath to my loveing wife Ann BARBER her Bible, Chest and Deske; and all my linnens whatsoever to be att her own disposall , together with all such Corn, Wheat, Malt, Meal and other victualls as shall remaine in the house after funeral And whereas I the said Thomas BARBER In and by one certaine writing or Deed of Settlement formerly by me made and executed wherein Charles KYRK late of Shireoaks was (amongst others) named a Trustee; have not only settled a certaine part of my then messuage lands tenements hereditaments and premises lyeing att or neer unto the Malcoffe aforesd upon my son William BARBER and his heires Male lawfully begotten etc. But have alsoe settled upon my said loveing wife Ann BARBER a competent Dower or Joynture (in case she shall happen me to survive) as amongst other things relaton? being thereunto had it will more plainly and att large appear Now my will and mind is that if my said loveing wife Ann BARBER shall and do loveingly and peaceably accept of the same and shall own and express her selfe to be fully sattisfyed therewith without makeing any further demands of any Dower Joynture or thirds forth of any part of the rest of my Messuage Lands and tenements Goods or Chattels whatsoever, But shall rest sattisfyed therewith, according to the true intent of the before in part writed Deed or writeing That then and in such case, and not otherwise, My will and mind is that my said loveing wife shall have free liberty (during her widowhood and for the terme of her natural life in case she shall not marry) to use as she shall have occasion any, or all of those Household Goods now next mentioned (viz) My best Bed One little Cupboard One Spinning Wheel One Skellett, One Bread iron, One half dozen of trenchers, two pewter dishes, two pewter plates, one small Barrel, one white pott, Three pewter cups, two Chaires one little Table, But not to have liberty or power to sell, lend or otherwise dispose of any of the same.  Item I give and Bequeath unto my son William BARBER those two Books called Mr BAXTERs Sth Everlasting rest and farewell Sermons.  And the rest of all my Books I give unto my Grand Children to be equally divided amongst them, And my will is that my said Loveing Wife shall upon request by her to any of them made have liberty to read or perruse any of them ever returning the same back in due time to the Owner thereof.  And whereas I formerly lent unto William CARRINGTON the younger late of Whyte Knowle now dcd, the sum of Eleven pounds which said sum is yet unpaid, It is therefore my will and mind, that if the same sum of moneys shall be paid to me in my lifetime, or to my Executors att any time after my decease, that my Executors shall within the space of one month next after they shall have received the same, pay unto my brother William BARBER the sum of Three pounds thereof. to my Brother John BARBER the sum of five pounds thereof, and to my sister Sarah SHIRT the sum of Three pounds thereof, if they be then liveing, and for want of of any of them such sum to be paid to their respective childe or children that shall be then liveing, if the said sum of eleven pounds shall be paid as aforesaid and not otherwise Item I give and Beqeath unto Thomas BARBER my grandson of Malcoffe One silver spoon and one silver ring, And unto the rest of my Grand Children each of them one Ewe.  Item I give and devise those Closes called the great lane head feild, as the same is now divided, the two Shallcross Feilds with the freehold Common belonging thereunto with all and every their Hereditaments and Appurtenances unto my said son William BARBER his heires and assigns for ever.  Item I give unto my said son William BARBER all my wearing aparell linen and woollen.  And whereas I have likewise formerly in the in part before writed Deed of Settlement (amongst other things) reserved to my selfe a power for want of Issue male lawfully begotten of the body of my said son William BARBER to charge part of my lands and tenements therein mentioned with any sum or sums of money not exceeding One hundred and fifty pounds the same to be raised by the Annual Sum of Tenn pounds or to the same effect; I do therefore pursuant to my power therein given, will, order, and appoint that for want of such Issue male liveing att the time of my son William BARBERs decease and failure thereof, such of my Brothers or their heires male lawfully begotten to whom such shall then come, shall so soon as they shall be possessed of, and vested in the same, well and truely pay or cause to be paid forth of the same premises unto such of my son William BARBERs children as shall be then liveing, the sum of Tenn pounds of lawfull money equally to be divided amongst them and so continue the same yearly sum of tenn pounds in like  manner until they shall have had and received amongst them the full and clear sum of One Hundred pounds.  And it is also my will and mind that if in case my said son William BARBER, or his heires shall at any time hereafter do or suffer to be done any act or acts thing or things whatsoever, whereby the right of inheritance belonging to any of my said Brothers or their heires male according to the true intent of the said Deed, shall contrary thereunto be barred, frustrated and defeated, That in such case it shall and may be lawfull to and for such Brother and Brothers, his and their heires to whom the same should have imediately descended uppon the Death of my said son, and his heires male, to enter into and upon all the said lands tenemts and premises with their Appurtenances mentioned in the said Deed as aforesd (excepting so much as att the same time shall be in my wives possession) and the rents issues and profitts thereof & of every part thereof (except before excepted) receive and take to his or their own use, untill they shall have had and received forth of the same the clear sum of one hundred and fifty pounds of lawfull money over and above all charges touching the same provided the same sum of one hundred and fifty pounds be not paid or otherwise sufficiently secured within the space of two months then next following.  Item I give and Bequeath unto my Grand-daughter Ellen KNOWLES the sum of Fifty pounds which is oweing to me by my son William BARBER, when she shall have attained to the full age of one and twenty yeares and it is my will and mind that the same shall continue in my said son Williams hands upon good security, he paying unto my said Grand daughter or for her use the interest yearly arising therefrom, until she shall have attained to the full age of one and twenty yeares, and if it shall happen that my said Grand-daughter Ellen KNOWLES shall not attain to the age of one and twenty yeares then my will and mind is that the said sum of fifty pounds in my son William hands shall be disposed of as followeth (viz) to my Brother William BARBER the sum of five pounds thereof, to my Brother John BARBER five pounds thereof, to my Sister Sarah SHIRT five pounds thereof, and for want of them the same to be paid to such of their respective children as shall survive, and my will and mind is that the remainder of the said sum of fifty pounds being thirty five pounds shall in  such case be distributed amongst my Grandchildren (viz) Mary, Edward and Ann BARBER.  Item I give and devise unto my Grandson Thomas BARBER that peice of new ground lyeing att the Breckedge which I lately bought of my Brother John? (torn) BARBER, to be and remaine unto him the said Thomas BARBER his heires and assignes for ever, Hee paying forth of the same unto  my said Granddaughter Ellen KNOWLES, or for her use, the yearly sum of twenty shillings for the terme of one and twenty years, and the further sum of tenn pounds att the end that terme if she be then liveing, and for want of him the said Thomas BARBER Jun. his heires I give and devise the same close last mentioned unto Edward BARBER my Grandson his heires and assignes for ever paying the yearly rent of twenty shillings for the terme and in manner aforesaid and the said sum of tenn pounds att the end of the said terme unto the said Ellen KNOWLES if she be then liveing.  Item all the rest and residue of all my goods and chattells whatsoever remaining over and above the charges of my Funeral and Probate of my Will, as well those goods lent to my wife as above sd (after her decease in case she do not marry) as all other my Goods and Chattells whatsoever I give the same as they shall come to my Executors hands, unto my three Grand Children (viz) Mary Edward and Ann BARBER equally to be divided amongst them.  Item I give unto my loveing freind Thomas HARISON of Losehill the sum of five shillings Item I do hereby appoint my sd loveing wife Ann BARBER and my said loveing freind Thomas HARISON my Joynt Executrix and Executor of this my last Will and Testamt. hopeing they will performe the trust I have reposed in them revoakeing alll former Wills and Testamts by me heretofore made and Lastly I desire my loveing freinds Samuel KYRKE of Coat banke and George WARD of Brown Syde both of them that they will be aiding and assisting in the premisses to see that this my will be faithfully discharged. In Witness whereof I the said Thomas BARBER the Testator my hand and seal have hereunto putt the day and year first above written.

Which day appeared Personally Ann BARBER and alleged that Thomas BARBER of the Parish of Chapel en le Frith in the County of Derby and within the Peculiar and Exempt Jurisdiction of the Dean & Chapter Yeoman deceased died upwards of fourteen days ago Intestate and that she is the widow & Relict of the said deceased and the Person to whom Letters of Administration do of right belong wherefore she Prayed Letters of Administration of all and singular the goods of the said deceased to be given to her which the surrogate on giving good security and taking the usual oath Committed to accordingly    She being sworn before me Thos GROVE Surrogate

In the name of God Amen the fourth day of February In the yeare of our Lord God one thousand six hundred sixty six I William BARBER of Malcolfe in the parish of Chapel in le Frythe in the County of Derby Gent being but weake of body but of pfect memory praysed bee God for the same well weighinge with myselfe the certainty of Death & the uncertainty of the tyme hereof and being desirous such tempall estate as Almighty God of his bounty hath bestowed upon me in this Life may bee reasonably enjoyed after my decease according to my will and my ende doe ordaine & make this my last Will & Testament in writing in manner & forme following And first & most principally I comitt my Soule to Almighty God my Creator & to Jesus Christ my Redeemer and to the holy Ghost my Sanctifier three persons & but one God from the beginning everlasting Amen to bee one of Christs Elect Saints whome hee hath caused to call with that heavenly voice ... you blessed of my Father inherritt the Kingdome prepared for you And I bequeath my body to the Earth whence it was to bee buryed in Christian buryall in the parish Church of Chapell in the Fryth in my Ancestors burying place in full assured hope & confidence that my body shall certainly rise againe a glorious body at the generall Resurrection of all flesh & bee reunited again with my Soule both to live together eternally with my only Saviour & Redeemer Christ Jesus in his everlasting Kingdome of heaven there to glorifie & praise God everlasting And I dispose of my worldly Estate as followeth First I give and Devise one messuage or Tenement with the Appurtenances at Brigreand? (Bridgeholme?) within the parish of Glossop and County of Derby & all those buildings Lands and hereditaments hereunto belonging which now are in the tenure & occupation of Cisley SHUTTLEWORTH or of her Assigns unto my Brother Thomas BARBER and his Assigns for the term of his naturall life yeildinge & payinge the yearly Rent of tenne shillings of lawful English money at the feast of St Martin the Bishop in Winter yearly dureinge the said terme unto such pson & psons as I shall hereafter by this my last Will and Testament give the reversion & Inheritance of the said Messuage or Tenement Lands & premises upon the Condition nevertheless that if the said Thomas BARBER my Brother or his heires or Assignes shall by any Suite or Suites or otherwise bee trouble or molest either my Executors hereafter named or any other pson or psons whom I shall hereafter by this my last Will give my Lands and Tenements or any ... thereof then it is my will  that my said Brother Thomas BARBER shall loose & forfeit his said Legacy unto such pson or psons as the Reversion of the said Messuage or Tenement Lands & premises shall by vertue of this my last Will and Tenement ..... and come unto And that my executors hereafter named shall give and pay unto my said Brother Thomas twelve pounds of lawfull money upon demand in full discharge of all Gifts and Legacies whatsoever And I give devise & bequeath as well the said Messuage or Tenement Lands & premises with the Appurtenances hereby formerly given to my said Brother Thomas upon condition as aforesaid imediately after the decease of my said Brother or other determination of his Estate As alsoe all & singular other my Messuages elsewhere within the realm of England And all & every of them with their & every of their Appurtenances And the Reversion wch are or shall bee found ..... with or in possession or reversion & Reversions remainder & remainders Rents & Services & other yearly pfitts thereof unto the heires male or female of my body lawfully issuing for ever excepting the Lane Side luifings? now in the tenure occupation  of Edward LINGARD within the parish of Glossop which I give unto William BARBER my Nephew sonne of Nicholas BARBER my late Brother deceased for & duringe the tyme & terme of his life And his Assigns And for & duringe the terme of the Life of John LINGARD of Hull [Hall?] sonne of John LINGARD deceased And for and dureing the life of Charles KERK sonne of Charles KERKE of Sherrocks (Shireoaks?) As also I give to the aforementioned William BARBER one Tenement and the appurtenant lying in a place called Ladysha in Chinley now in the possession of Mrs? DACKEN And after her terme bee expired the Inheritance to the said William BARBER for ever but in case the said William BARBER dye without Issue lawfully begotten the aforenamed promised to return to the right heires of me the said William BARBER Testator Alsoe I doe appoint & make William BAGSHAW and John HEYWOOD my Brother in Laws as Guardians to the said William BARBER And the estate that I have left him or hereafter should fall to him till hee accomplish the age of one & twenty & to noe other pson without theire appointment whatsoever And for want of issue of me the said William BARBER Then I doe give & bequeath all the aforesaid Messuages Lands Tenements hereditaments whatsoever to the said William BARBER sonne of Nicholas BARBER my late Brother deceased and to the heires of his body in as full a large manner as before mentioned I have done unto my owne And for want of such issue then to the issue male of Thomas BARBER my Brother And for want of such issue to then to William COWPER my kinsman pvided that he the said William COWPER doe pay or secure to bee paid to my Executors after named the summe of Six hundred pounds wch said summe is to bee given proportionally by my Executors to such psons that shall bee after named for an Augmentation of such Legacies as are already given unto them.  And for my psonall Estate it is my will that all my household goods & husbandry ware shall be kept & pserved by my Executors hereafter named to & for the use of such pson & psons as shall by vertue of this my last Will inherritt my said Lands And it is my will that my funerall dues & expenses & charges of the .... of my Will & such debts as I duly owe to any one And all such charges & expenses as my Executors hereafter named shall necessarily expend & lay forth And all such Legacies wch hereafter in & by my Last Will and Testament I doe give to any one shall bee paid and discharged forth of all the rest of my goods Rights Cattells & Chattells And I give and bequeath

In the name of God amen This twenty fifth day of March 1736 I James CARRINGTON of Chinley Houses in the parish of Glossop and County of Derby being aged and infirm in body but of sound mind and perfect memory praise be therefore given to almighty God for the same and calling to mind the certainty of death do make and ordain this my will and testament in manner following, First I commend my soul into the hands of almighty God hoping to receive full pardon & forgiveness of all my sins through the death and merits of Jesus Christ my redeemer and to inherit everlasting life and my body I commit to the earth from whence it was taken to be decently buried at the discretion of my executors hereinafter named and as touching such worldly goods and estate it hath pleased God to bestow upon me I do give and dispose of the same as followeth.   It is my will and mind that all my just debts and funeral expenses be first paid and discharged out of my personal estate Item I give and bequeath the sum of four score pounds to Thomas KYRKE of Spire Hollin, Thomas GEE of Lydiate and James CARRINGTON my son, and to the survivors of them in trust for the uses hereafter mentioned. To witt it is my will and mind that my said trustees shall receive and keep the said fourscore pounds in their custody and possession for and during the life of my daughter Elizabeth CARRINGTON paying her yearly and every year the interest or product thereof and it is my will and mind that after the death of my daughter Elizabeth the said trustees or their survivors do pay the interests and profits of the said fourscore pounds  to the issue of my daughter by equal portions if she leave one or more children till they attain the age of twenty one years and such of them that die before their proportion to go to the survivors and it is my will and mind that as any of her children shall attain the age of twenty one years my said trustees do pay them their proportional share of the principal sum But if she die without issue or her issue all die before they attain that age it is my will and mind and I do hereby give the said sum of fourscore pounds to my son James CARRINGTON my executor he indemnifying my said trustees from all charges and expenses on account of their said trust.  Item I do give unto my daughter Elizabeth one bedstead with that bedding which is now marked for her with the letter E together with one little brass pot.  Item I give to my daughter Ellen BRADDOCK the sum of five shillings together with one cow which she has in her custody and also one fire iron, one little table standing at Little Hayfield during her natural life and at her decease I give the said fire iron and table to my grandson John BRADDOCK. Item I give unto my grandson John BRADDOCK one bedstead standing in the lower parlour with that bedding lettered with the letter B together with my chest standing at my beds feet. Item I give unto my granddaughter Hannah BRADDOCK the sum of twenty shillings to be paid to her twelve months after my decease. Item I give unto my son-in-law John BRADDOCK the sum of two shillings and sixpence. In the name of God Amen.  I, Thomas GREEN of Bottoms Hall in the parish of Taxall in the county of Chester, Husbandman being weak of body bout of sound, perfect and disposing mind and memory praised be God for the same and considering the shortness and uncertainty of this transitory life and that all flesh must yield unto death do make, publish and order in this my last Will and Testament in manner and form following.  First and principally I recommend my soul to Almighty God that gave it and I commit my Body to the Earth to be decently buried at the discretion of my Executors hereafter named and as touching and concerning my worldly Estate which it hath pleased God to bestow upon me I give, devise and bequeath the same and every part thereof as followeth and First I will and do hereby order that all my just debts, funeral charges and the probate of this last Will and Testament be fully paid and discharged out of my personal Estate and then I give and bequeath unto my children James GREEN, Hannah the wife of Thomas BARBER, Thomas GREEN, Joseph GREEN, Ralph GREEN, George GREEN, William GREEN, Samuel GREEN and John GREEN I give and bequeath to all my said children all my Estate real and personal in Money Goods Bills Bonds Notes and other securities to be equally divided amongst them share and share alike what having been received by any of the above mentioned children to be considered as part of their share of the above property.  And as my son James has had already from me twenty three pounds and one shilling And my daughter Hannah twenty three pounds eight shillings And my son Thomas twelve pounds twelve shillings And my son Joseph nineteen pounds eight shillings and my son William twenty one pounds and my son Samuel four pounds and the remaining part that shall appear due to the said Samuel to be left in the Executors hands to be disposed of as they shall think proper.  I will that all the Household Goods and one cow that my wife Nanny brought with her to my House shall be at her own disposal immediately after my decease Also I bequeath to my said wife five pounds in lawful Money and it is my mind that my sons John and Ralph have the goodwill of the House and Farm and the Household goods and Cattle and all Husbandry Wares to be valued by two sufficient persons appointed by the Executors and the said Ralph and John to have them at the valuation if they think proper.

In the name of God Amen the twelfth day of January 1719/20 and in the sixth year of the reign of our Sovereign Lord George by the grace of god over Great Britain and defender of the faith: I Ann KYRKE of Martinside, in the parish of Chapel-en-le-Frith, and County of Derby, Widow and relict of Henry KYRKE of Martinside late deceased, being of perfect mind and memory, yet under some indispositions of body, and taking to mind the frailty and mortality of this life, I do make and ordain this my last will and testament  in manner and form following.  Imprimis I give my soul into the hands of almighty god my creator hoping through the merits death and suffering of my redeemer Jesus Christ to inherit eternal life and my body to the earth to be decently interrd at the discretion of my executors hereafter mentioned. The Will of Margaret KIRK (Peggy) Of Martinside 1796

This is the last will and testament of me Margaret Kirk of Martinside in the parish of Chapel-en-le-Frith within the county of Derby. Widow and relict of Henry KIRK of Martinside aforesaid being weak of body but of sound disposing mind  memory and understanding (praised be God for the same) Made in manner and form following.   First I order and direct all my just debts funeral expenses and the charges attending the probate and execution of this my said will to be first paid and discharged out of my person estate by my executors hereinafter named . Then I leave  the sum of One hundred pounds to be put out to interest by my executors upon good security as soon after my decease as possible and the interest arising therefrom to be by them paid to Margaret NALL wife of John NALL of Little Bowden yearly and every year as it shall become due from the day of my death during her natural life, and if the said John NALL shall survive the said Margaret NALL his wife then I direct the said interest to be paid to the said John NALL as aforesaid during his natural life. And at the death of the survivor of them I give and bequeath the said hundred pounds to the children of the said Margaret NALL to be equally divided amongst them share and share alike as they attain the  age of twenty one years and if any of them shall happen to die before their share shall be come due leaving lawful issue then his or her share so to go to such issue and if any of them shall happen to die as aforesaid leaving no such issue then the share of him her or they  so doing to be equally divided amongst the survivors share and share alike as they shall attain the age aforesaid.    The interest of those that may be under the age aforesaid I leave to the discretion of my exors. Either to add it to the stock or lay it out for their use as they may see occasion.

I give and bequeath to my nephew Anthony BELLOTT the sum of forty pounds includng the sum of thirty pounds which he has of mine in his hands to be paid at the twelve months next after my decease and if he shall happen to die before his legacy becomes due then I leave the sum of ten pounds to be divided amongst his children share and share alike.

I give and bequeath to my nephew Henry YATES the sum of eighty pounds to be paid the twelve months next after my decease and if he should die before the legacy becomes due I give the said sum of eighty pounds to his children to be equally divided amongst them share and share alike.

I give and bequeath to my nephew Richard MIDDLETON the sum of eighty pounds including the sum of twenty pounds which he has of mine upon his note to be paid as aforesaid and if he shall happen to die before his legacy becomes due then I give the said sum of eighty pounds to his children to be equally divided between them share and share alike.

I give and bequeath to my nephew Thomas MIDDLETON the sum of eighty pounds to be paid as aforesaid and if he shall die before his legacy becomes due then I give the said sum of eighty pounds to his children to be equally divided between them share and share alike.

And it is my will and mind and I do hereby order and direct that if any of the aforementioned  shall happen to die before his or her legacie shall become due namely Ann BRIERLEY, Daniel KIRK, Benjamin YATES, Richard MIDDLETON, and Thomas MIDDLETON leaving either child or children under the age of twenty one years that the interest of the share such as child or children shall either be added to the stock or laid out for their use of such child or children at the discretion of my exors. After the rate of four pounds per cent per annum until they attain the age of twenty one years and if such child or children shall die before they shall attain the age aforesaid then the share of such child or children to be equally divided amongst the surviving brothers and sisters share and share alike   I give and bequeath to Mary the wife of Jeremiah WALKER the sum of twenty pounds to be paid at the end of twelve months next after my decease and if she shall not be living at that time then I give the said twenty pound to Jeremiah WALKER if he be living if not to go to the reversion.

INDENTURE Arnold Kyrke  Eldr. & Arnold Kyrke Jnr.

In an indenture made the 30th of June 1619 ARNOLD KYRKE the ELDER of “Martinside” Yeoman  lawfully seized of one capital messuage commonly called Martinside in the parish of Chapel-en-le-Frith & County of Derby passed his estate to his son ARNOLD KYRKE the Younger. The young Arnold paying to his father and his now wife Anne a yearly rent and keeping them in meat drink apparel and lodging for the rest of their natural lives. 

*note Arnold the elder and Anne both died in 1622 and were buried at Chapel-en-le-Frith.  

Arnold the younger died in 1640 leaving a will dated 18th June 1640

Arnold KYRKE the elder of Martinside will dated 18th of June 1640 

Wished to be buried in the parish church of Chapel-en-le-Frith .

He leaves his estate to his son and heir Arnold .

To his daughter Katherine twenty two pounds, fifteen shillings and ten pence on the feast days of Philip and Jacob.  To his son Thomas the same when he reaches 21 years of age.   To his sons Thomas, Henry & George the same.   His son Arnold is to pay to Ralph SMITH of Buxton twenty pounds which he owes to him.   To John GASKELL his son-in-law the same.

It is his wish that his son Arnold shall enjoy and occupy the close called Hallstidds ( Hallsteads) during its term and paying £5 to his brothers Thomas Henry George & to Katherine. Also to Katherine another £10 to be paid within three years of his death.  To these same children he leave one messuage and five acres of land at Wormhill, the Hill and Hargate Wall in the High Peak which is in the occupation of one Humphrey DAKIN together with one beastgate in the herbage of Green Fairfield and all his right and title to the Over end of Green Fairfield belonging to the said messuage and three acres of land in Fairfield in the tenure of Robert Swan and Nicholas Swan of Fairfield.   To his daughter Anne GASKELL 12 pence. To Anne GASKELL`s son John one sheep   and to every godchild 12 pence.  To Edward WRIGHT his servant one sheep or five shillings (his choice)  To all his other servants two shillings and six pence each over and above their yearly wages if they still live with him at his death.    To his sister Dorothy SHIRT one Edward Shilling.   To his executors five shillings and to their wives 12 pence each.  To Thomas, Henry, George and Katherine all other chattels not named along with all bills and bonds . His named executors are his brother Henry KYRKE his son-in-law John GASKELL and his son Arnold KYRKE.

In the name of God Amen.  I Arnold KYRK of Martinside in the parish of Chappell le Ffrith and county of Derby Yeoman being in perfect health and of sound mind memory and understanding do make publish and declare this my last will and testament in manner and form following.  Ffirst I commend my soul into the hands of God and my body to the earth to be decently interred at the discretion of my executors hereafter named Ffirst of all after any just debts and expenses are paid and discharged  I give devise and bequeath all those my ffreehold lands Messuages and tenements and heraditaments lying being and situate at Martinside  and Jumble with all the common lands thereunto belonging and also all that land called nearer Halsteds with the rents issues and profits of all and singular the said premises unto my son Henry KYRK and his assigns for and during the term on ninety nine years if the said Henry KYRK shall so long live and from and after his death or other determination of the said terme  and estate then unto the use and behalf of the heirs male of the body of the said Henry KYRK lawfully begotten And for want of his heirs male I give the before mentioned messuages lands and premises unto my son Thomas KYRK and his assigns for and during the term of ninety nine years if the said Thomas KYRK so long live and from after his decease or other determination of the said terme and estate to the use and behalf of the heirs male of the said Thomas KYRK lawfully begotten And for want of such male issue to my brother Thomas KYRK of Spire Hollin and his heirs male and in default of such issue male then to the right heirs of me forever. Subject nevertheless to the charges hereafter mentioned and if it shall happen that my son Henry KYRK depart this life without issue male it shall and may be lawful for the said Henry KYRK  by any other will or writing under his hand and seale to change his whole or any part of the said estates and premises before mentioned With payment of any sum of monies not exceeding the sum And of four hundred pounds for payment of debts or younger childrens portions  And I do hearby also give to my son Henry KYRK to charge all or any part of the before mentioned premises with the payment of  any sum of monies yearly not exceeding the sum of tenn pounds at such times  and days as he shall limmit and think fit to be and for a jointure for a wife during her trust and if the said before mentioned premises shall command to my son Thomas KYRK and dye without male issue then my will and mind is that it shall be lawful for my son Thomas KYRK  to charge the before mentioned premises with payment of any sum of monies not exceeding the sum of four hundred pounds  for payment of debts or younger childrens portions And if it happen that my sons Henry KYRKE and Thomas KYRK depart this life without issue male then it is my will and mind is that I do give and bequeath unto such daughters as my sons shall have living the sum of seven hundred pounds to be equally divided amongst them to be paid them by my brother Thomas KYRK or his heirs and in default of the payment then the said sum of seven hundred pounds aforesaid to be nul and void And I do hearby give and devise the said premises before devised  to them and the right heirs of me forever.   And I give and devise to my son Henry KYRKE his heirs and assigns for ever all those closes calles Yeavly Halsteds with all appurtenances thereunto belonging  And I give and bequeath unto my son Henry KYRK all those lands and tenements lying and being upon Doveholes and (Twidish) Moor which I hould by lease from Mr Henry EYRE chargeable nevertheless with the payment of such legacies as shall hereafter be mentioned And I give and bequeath unto my son Henry KYRK all my right and title to that land which I hould by lease from the Duke of Devonshire in Peak Forest called Little ( /close) and I give and devise one parcel of common land lying at Blackbrook Moor which I purchased from Stephen BELLOTT with all priviledges thereunto belonging unto my son Thomas KYRK and his assigns for and during theterme of ninety nine years if the said Thomas KYRK so long shall live and from and after his decease or other determination of the said term and estate then to the use and behalf  of the heirs male of my son Thomas KYRKE lawfully begotten And if my son Thomas KYRK dye without heirs male then from and after his deacese to the heirs male of my son Henry KYRK and for want of such male issue to the right heirs of me forever.  And I give I and bequeathto my son Thomas KYRK the sum of two hundred pounds and I give to my granddaughter Betsy KYRK one guinea. And I give and devise to my daughter Ann Barber the sum of two hundred pounds and I give unto my granddaughter Ellen BARBER one guinea And all the rest and residue and remainder of my worldy goods and effects whatsoever  I give devise and bequeath to my son Henry KYRK and I hearby appoint and nominate my son Henry KYRK and my brother Thomas KYRK executors of this my last will and testament hereby revoking all former wills hereunto made in witness whereof have hereunto set my hand and seal this thirtieth day of August in the year of our Lord 1744

Arnold KYRK died at about two in the morning on April 13th 1745

His son Henry was then un-married.   He was to marry his cousin Margaret of Spire Hollin in 1748 but they had no surviving children.   I think that Thomas MARCHINGTON was his man servant who came to tell Dr. CLEGG his master had died.

The Martinside estate passed on the death of  Henry to Richard the son of his brother ThomasRichard lived in Wales and it was to his son Henry the Martinside estate was willed. However, he died young and Richard let this and Spire Hollin which Henry inherited from his uncle Thomas in 1749 to Adam FOX who eventually bought them both.

Ann BARBER`s husband hanged himself in a barn at Malcoff according to the parish record at Chinley and she married Charles SHIRT of Bowden Head.

Henry’s widow, her cousin Margaret names some of her children in her will dated  1796

In the name of god amen I Henry KYRKE of Martinside in the parish of Chapel-en-le-Frith in the County of Derby yeoman being in good health and perfect memory praised by God for the same do make and ordain this my last will and testament in manner and form following that is to say First and principally I comment my soul into the hands of almighty God my maker hoping to be saved through the merits of my Alone saviour Jesus Christ and to inherit everlasting life and my body I commit to the earth to be decently interred in such manner as my executors hereafter named shall think fit and convenient. And as for and concerning such worldly estate as it hath pleased Almighty God to bestow upon me I dispose thereof as followeth.  Imprimis I give devise and bequeath unto my dear and loving wife Anne KIRKE all that part of the messuage with appurtenances situate standing and being at Martinside aforesaid wherein I now inhabit And all those part of the outhouses now in my possession together with that part of the Fold Croft and gardens I now enjoy an all those several closes (parts) and parcels of land meadow or pasture to the said messuage belonging and herein after particularly mentioned that is to say The Lower Overfield, the further Jumble Field, the Bank the Leys and one dwelling house called the Jumble House with appurtenances together with the lands belonging to the same commonly called The Fould, The Kiln Croft, The Twittow, the Intake the Great Callowfield, the Little Callow Field, and the Round Croft with their and (   ) of their appurtenances to hold the said messuage tenements and premises to the said Anne and her assigns for and during the term of her natural life in lieu and full satisfaction of her jointure or dower at the common law which she can or may hereafter claim forth of any of my lands or tenements I shall die seized of. And also I give to her the best cow I shall have at my death and the best bed with all its furniture And after the decease of the said Anne then I give devise and bequeath the said messuage, house farm and premises unto my son Arnold KIRKE and his assigns for and during the term of ninety nine years if he the said Arnold KIRKE shall so long live And from and after his decease or other determination of the said term and estate then to the use of the heirs male of the body of the said Arnold KIRKE lawfully to be begotten and for want of such issue male then I give devise and bequeath the said messuage farm and premises above mentioned unto my son Thomas KIRKE and his assigns for and during the term of ninety nine years if he the said Thomas shall so long live and from and after his decease or other determination of the said term and estate then to the use and behalf of the heirs male of the body of the said Thomas KIRKE lawfully to be begotten and for want of such issue to the use of Thomas KIRKE of Whitehills in the said parish of Chapel-en-le-Frith my brother and the heirs male of his body lawfully begotten or to be begotten and for default of such issue to the right heirs male of me for ever subject to the charge hereafter mentioned. appurtenances now in my possession commonly called the name of Halsteads and also the moiety or one half of the Ferneyside the one half of the Howles the moiety on one half of the meadows and the one half of the woods upon this condition that he the said Arnold or he or they to whom the premises last mentioned shall descend do well and truly pay or cause to be paid to my loving mother Anne KYRKE or her assigns yearly and every year for and during her natural life the sum of fifteen pounds of lawful money of England at Michalmas and Lady Day by even and equal portions or within forty days next after such feasts without any deduction or abatement for or in any respect whatsoever and in default thereof it shall and may be lawful to and for the said Anne or her assigns to enter upon the said premises last mentioned and distrain and the distress or distressers so taken to load drive impound sell and dispose and detain the same until such time as she shall be satisfied all ( A-------) and after the decease of the said Anne KIRKE or other determination of the said term then to the use of the heirs males of his body lawfully to be begotten and for want of such issue male then I give devise and bequeath the premises last mentioned to my said son Thomas KIRKE and his assigns for and during the term of ninety nine years if he the said Thomas KIRKE shall so long live and from and after his decease or other determination of the said term to the use and behest of the heirs male of the body of the said Thomas KIRKE lawfully to be begotten and for want of such issue male to the use and behest of the heirs males of the body of my said brother Thomas KIRKE begotten or to be begotten and for want of such issue to the right heirs of me for ever subject to the charge hereafter mentioned.  Item I give devise and bequeath unto my said son Arnold KIRKE all that messuage with appurtenances situate standing and being at Martinside aforesaid which he now hath in his possession with all those parts of the outhouses now in his possession together with all the other part of the Fould which is not bequeathed before which are in his possession with the crofts and gardens not before disposed of and all the several closes parts and parcels of meadow and pasture to the said messuage belonging and herein hereafter particularly  mentioned that is to say the Lower Overfield, the nearer Jumble field, the Barnehill the back of the Barnehill the Pitmore Croft, and the (Cotelands?) with the other moiety of the Ferneyside , Hoults woods and meadows not before disposed of and Cotes belonging thereunto now in his possession for and during the term of ninety nine years if the said Arnold KIRKE shall so long live.  And from and after his decease or other determination of the said term then to the use and behest of the heirs male of his body lawfully to be begotten and for want of such issue male then I give and devise the said last mentioned premises in the said Arnold possession to my said son Thomas KIRKE and his assigns for and during the term of ninety nine years if the said Thomas so long shall live and from and after his decease or other determination of the said term then to the use and behest of the heirs male of his body lawfully to be begotten and for want of such issue male then to the use and behest of the heirs male of my brother Thomas KIRKE and for want of such issue male to the right heirs of me for ever subject to the charge hereafter mentioned and if it shall happen that my said son Arnold KIRKE shall depart this natural life without issue male of his body lawfully begotten and leave one or more daughter or daughters and be indebted  then it is my will and mind and it shall be lawful to and for such daughter or daughters to enter upon the said Halsteads the half of the Ferneyside the half of the Hoults the half of the meadows the half of the ( Howles) half of the woods and the said lands now in the said Arnold KIRKE’s possession with their appurtenances and to receive (   ) and take the rents issues and profits thereof until the full sum of three hundred pounds shall be raised out of the same if but one daughter and if there happen to be two daughters or more the sum of four hundred pounds to be equally divided amongst such daughters she or they first paying out the said such debts if any as the said Arnold KIRKE shall justly owe at the time of his death and direct to be paid and also if the Nearer Halsteads the moiety of the Ferneyside the moiety of the Hoults the half of the meadows and the half of the woods and the said other lands now in the said Arnold’s possession descend and come to my said son Thomas KIRKE and he die without male issue of his body lawfully begotten and leaves one or more daughter or daughters and be indebted then it is my will and mind and it shall be lawful to and for such daughter or daughters to enter upon the premises last mentioned and to receive (  ) and take the rents issues and profits thereof until the full sum of three hundred pounds shall be raised out of the same and if one daughter or more than one daughter the sum of four hundred pounds to be equally divided amongst such daughters she or they first paying out of the said sum such debts as the said Thomas shall justly owe at the time of his death and direct to be paid and if it shall happen that my said son Arnold shall marry then it is my will and mind and I do give power to my said son Arnold KIRKE to charge all or any of the premises now in his possession with any sum of money by any deed or instrument under his hand and seal not exceeding the annual yearly sum of ten pounds of lawful money of England at such days and times as he the said Arnold KIRKE shall limit and appoint so ( be for   ) and as a jointure for such wife as the said Arnold shall hereafter happen to marry for and during her natural life in case she happen to survive him the said Arnold KIRKE  And it is further my will and mind that if it happen that my said sons Arnold and Thomas KIRKE do depart this natural life without male issue of their bodies lawfully begotten so that the messuages lands and premises above mentioned to my said brother Thomas’s use then it is my will and mind and I do give and bequeath to such daughters as my said sons shall have and to such children as my daughters shall have the sum of seven hundred pounds of lawful money of England to be equally divided amongst my said grandchildren to be paid to them by the said Thomas KIRKE or such male issue of his body as shall enter upon the premises above mentioned by virtue of the device above within the space of two years next after such entry upon the said premises and in default of payment of the said seven hundred pounds in such manner aforesaid then the device made to the heirs male of said brother Thomas to be made null and I do hereby give and bequeath the premises so devised to them to the right heirs male of me for ever. Item I give and bequeath unto my said son Arnold his heirs and assigns for ever all that close or tenement with appurtenances commonly called or known by the name of Yeaveleys Halsteads which was purchased of Mr. Thomas YEAVELEY and now in the possession of my said son Arnold KIRKE then I give to my daughter Mary KIRKE the sum of one hundred and sixty pounds of lawful money of England to be paid to her by my executors hereafter named out of my personal estate after my debts and funeral expenses are paid and discharged And it is my will and mind that if my said daughter Mary happen to die before she is married then I give and bequeath the said sum of one hundred and sixty pounds to the said Arnold KIRKE and Thomas KIRKE my sons and to Joan KIRKE and Margaret WATERHOUSE widow and her children equally to be divided amongst them or amongst such of them as shall then be living. Item I give and bequeath unto my daughter Joan KIRKE her executors administrators and assigns all that messuage farm or tenement with appurtanances situate and being in Hanley in the County of Chester held by lease under Peter LEIGH of Lyme in the aid County of Chester Esq. To hold to the said Joan KIRKE and her assigns immediately from and after the decease of Anne my said wife for and during all the term and time expressed in the said lease and after my debts legacies and funeral expenses are paid and discharged then I give and bequeath all the rest of my personal estate unto the said Anne my loving wife and Lastly I do nominate and appoint the said Anne my wife and my said son Thomas KIRKE executors of this my last will and testament hereby revoking and disannulling all former wills by me at any time heretofore made and to this last will and testament I have set my hand and seal the third day of November in the third year of the reign of our sovereign Lady Queen Anne over England & Anno Dom 1704

In the name of God Amen I Henry KIRK of Martinside in the parish of Chapel-en-el-frith and County of Derby Gentleman being of sound and disposing mind memory and understanding praised be God for the same do make ordain and declare this my last will and testament in manner and form following (that is to say) First I commit my soul into the hands of almighty God who gave it and my body to the earth to be decently buried at the discretion of my executors hereinafter named. And as touching my worldly estate wherewith it hath pleased God to bless me in this life I dispose of the same in manner and form following. (that is to say) First I will that all my just debts and expenses of my funeral and charges of and attending the probate and execution of this my will be paid and discharged by my executors herein after named by and out of my personal estate. One annuity or yearly sum of four pounds of lawful British money to be paid yearly and every year for and towards his or her of their maintenance and education until Henry BARBER shall have attained the age of twenty three years or sooner die charged and chargeable on my said lands and premises at the further side of the Meadows aforesaid.  The first payment thereof to begin and be made at twelve months after my decease and if my said nephew William BARBER should happen to die before Henry BARBER his said son shall have attained the age of twenty three years Then I give and bequeath unto the child or children of my said nephew William BARBER who shall be living at the time of his decease.  (Henry BARBER son of my nephew William BARBER only excepted)  One other annuity or yearly sum of four pounds of lawful British money to be paid yearly and every year by two equal portions or half yearly payments in each year for and towards his or her or their maintenance until the said Henry BARBER shall attain the age of twenty three years charged and chargeable on my said lands and premises situate and being at the further side of the Meadows aforesaid.  The first payment thereof to begin and be made at six months next after the decease of my said nephew William BARBER and when and so soon as the said Henry BARBER shall have attained the age of twenty three years. Then I give and devise all my said lands and premises situate and being at the further side of the Meadows aforesaid and the rents issues and profits of all and singular the said premises unto the proper use and behoof of the said Henry BARBER his heirs and assigns for ever subject nevertheless to the said annuity or yearly sum of sixteen pounds payable to my said nephew William BARBER for and during the term of his natural life in case my said nephew William BARBER shall then be living and subject also to the payment of one hundred pounds of good and lawful money of Great Britain to be paid to the child or children of my said nephew William BARBER who shall be living at the time of the said Henry BARBER’s attaining the age of twenty three years or to his or her or their respective lawful issue in the parents stead equally share and share alike. The said sum of one hundred pounds to be paid as directed within twelve months after the said Henry BARBER shall have attained the age of twenty three years and in case the said Henry BARBER should happen to die before attaining the age of twenty three years  Then and upon such contingency I give and devise all my said lands and premises situate and being at the further side of the Meadows aforesaid and the rents issues and profits thereof unto the lawful issue of the said Henry BARBER and his or her or their several and respective heirs and assigns for ever to have and to hold all and singular the said lands and premises with the appurtenances unto and to the only proper use and behoof of such said lawful issue and his or her and their several respective heirs and assigns for ever as tenants in common and not as joint tenants  if more than one and if but one then wholly to that one his or her heirs and assigns for ever and for default of such said lawful issue then I give devise and bequeath all my said lands and premises situate and being at the further side of the Meadows aforesaid and the rents issues and profits thereof unto and to the only proper use and behoof of the brother or brothers of the said Henry BARBER who shall be living at the time of his decease and to his or their respective heirs for ever to have and to hold as tenants in common and not as joint tenants if more than one but if one the wholly to that one his heirs and assigns for ever and for want of such brother or brothers then I give and  bequeath the said mentioned premises with their appurtenances and the rents issues and profits thereof unto the proper use and behoof of the sister or sisters of the said Henry BARBER who shall be living at the time of his decease and to her or their respective heirs and assigns for ever to hold the same premises as tenants in common and not as joint tenants if more than one and if but one then wholly to that one her heirs and assigns for ever subject nevertheless to the said annuity or yearly payment of sixteen pounds payable to William BARBER during the term of his natural life as aforesaid in case he be then living.  I give and bequeath unto MARGARET my loving WIFE and her assigns one annuity of thirty pounds of lawful British money to be paid to her or her assigns yearly and every year for and during the term of her natural life life two equal portions or half yearly payments in each year charged and chargeable on my said messuage and tenements situate and being at Martinside aforesaid The first payment thereof to begin and be made at three months after my decease. I also give and bequeath unto my said loving wife Margaret her executors administrators or assigns the sum of three hundred and thirty pounds of lawful British money charged and chargeable upon my said messuage, lands and premises situate and being at Martinside aforesaid and charged upon the personal estate and effects that I shall die possessed of and to be paid to her her execs or administrators or assigns within twelve months next after my decease.

I give devise and bequeath unto my sister Ann SHIRT of Chapel-en-le-Frith in the County of Derby widow one annuity or yearly sum of four pounds to be paid to her yearly and every year for and during the term of her natural life by two equal portions or half yearly payments each year charged and chargeable on my said messuage lands and premises situate and being at Martinside aforesaid  the first payment thereof to begin and be made within Six months after my decease

I give devise and bequeath unto my niece Ellen BRUSBY daughter of my sister Ann SHIRT one annuity or yearly sum of three pounds of lawful British money paid to her yearly and every year during the term of her natural life charged and chargeable on my said messuage lands and premises situate and being at Martinside aforesaid. The first payment thereof to be made at twelve months after my decease, and from and immediately after the decease of the said Ellen BRUSBY in case she leave any lawful issue give and bequeath unto such lawful issue the sum of sixty pounds of lawful British money charged and chargeable on my said messuages, lands and premises situated and being at Martinside aforesaid.  And to be paid to such lawful issue of my said niece Ellen BRUSBY or to the survivor or survivors of them at three months after her decease. I give and bequeath unto the brothers and sisters of the said Henry KIRK son of my nephew Richard KIRK the sum of one hundred pounds equally share and share alike charged on my said messuage lands and premises situate and being at Martinside aforesaid and to be paid to the survivor or survivors of them when and so soon as the said Henry KIRK son of my nephew Richard KIRK shall have attained the age of twenty three years or within twelve months after his decease provided he does not live to attain the age of twenty three years and my will is that upon the decease of the said Henry KIRK son of my said nephew Richard KIRK such or any of his said brothers and sisters who shall be his heir or heirs at law in case he leaves no lawful issue shall not be entitled to any part of the said one hundred pounds as along with his other brothers and sisters I give and bequeath unto my niece Ann wife of Joshua NALL of Chapel-en-le-Frith aforesaid Sadler the sum of sixty pounds I give and bequeath unto my niece Ruth BARBER of Chapel-en-le-Frith aforesaid spinster the sum of eighty pounds I give and bequeath unto my nephew Arnold KIRK the sum of eighty pounds I give and bequeath unto my nephew Henry KIRK brother of the said Arnold KIRK the sum of forty pounds I give and bequeath unto my nephew Richard KIRK brother of the said Arnold and Henry KIRK the sum of one guinea. I give and bequeath unto William MELLOR and Thomas SHIRT my two servant men each the sum of two guineas if they live with me at the time of my decease.  I give and bequeath to Sally BIRTLES granddaughter of my late brother Thomas KIRK deceased the sum of thirty pounds to be paid to her when and so soon as she shall have attained the age of twenty three years.   I give and bequeath unto the said Joseph HADFIELD the sum of ten pounds I give and bequeath to each of my executors hereinafter named the sum of ten pounds with the payment of which the said last legacies mentioned I charge my said messuages lands and premises situate and being at Martinside aforesaid and I will and direct that the said legacies so given and bequeathed by me to Ann the wife of Joshua NALL Ruth BARBER Arnold KIRK Henry KIRK Richard KIRK William MELLOR Thomas SHIRT Joseph HADFIELD and my two executors respectively as aforesaid to be paid within twelve months next after my decease I give and bequeath unto my said loving wife Margaret my said sister Ann SHIRT and the said Henry KIRK son of my nephew Richard KIRK all my bedding and linen whatsoever and wheresover  (except my wearing apparel ) to be divided amongst them share and share alike so soon as may be after my decease. I give and bequeath unto my loving wife Margaret for and during the term of her natural life or so long as she shall chose to dwell and remain at my messuage or dwelling house at Martinside aforesaid the use occupation and enjoyment of the Great Parlour in my said messuage and the chamber over the said parlour , the little parlour or lodging room and small cellar under the stairs in the said little parlour belonging also to and being part of my said messuage or dwelling house and all the furniture and appendages to the said parlour chamber and cellar and every or any of them belonging except my bedding and linen in the said rooms being before disposed of and all and every privilege and convenience in and about my said messuage or dwelling house that may be necessary to and for the full and free and undisturbed enjoyment of the same and from immediately after the decease of my said wife Margaret or her sooner ceasing to dwell and remain at my said messuage or dwelling house of Martinside aforesaid I give devise and bequeath the aforesaid Great parlour in my said dwelling house aforesaid the chamber over the it the said Little Parlour and the cellar under the stairs in the little parlour and all the aforesaid furniture and appendages to the said parlours and chambers belonging except the bedding and linen unto the only proper use and behoof of the said Henry KIRK son of my nephew Richard KIRK his heirs executors and administrators and assigns for ever.  It is my will and mind and I do hereby order and direct that my loving wife Margaret shall dispose of all my wearing apparel amongst such of my relations as she shall think proper so soon as conveniently may be after my decease all the rest residue and remainder of my real estate and personal estate whatsoever and wheresoever not hereinbefore by me disposed of I give devise and bequeath unto the said Henry KIRK son of my nephew Richard KIRK his heirs executors adminstrators and assigns absolutely for ever. And lastly hereby revoking all former and other will or wills by me at any time or times heretofore made and declaring this to be my last will and testament I do hereby nominate constitute and appoint Anthony BELLOTT of Castle Naze and Henry YATES of Ridge both within the parish of Chapel-en-le-Frith in the county of Derby aforesaid yeomen joint executors hereof.  In witness whereof I the said Henry KIRK the testator have to every sheet of this my will and testament which is contained in five sheets of paper set my hand and seal this twenty fifth day of September in the year of our Lord one thousand seven hundred and seventy nine.   Witnessed by William Harrison Sarah HARRISON and Daniel DYSON

In the name of God Amen September 3rd 1743 I Mary KIRK of Martinside, in the parish of Chapel-en-le-Frith and County of Derby Spinster, being weak and indisposed in body, but of sound mind and memory, praised be to God, for the same, And as for such worldly estate as it hath pleased God to endow me with. I give and devise the same as followeth. Imprimis My will and mind is that all my debts and funeral expenses be discharged and paid by my executors after named, Imprimis My mind and will is that the eightscore pounds which my father left me in his will be paid in manner following. Item I give & devise unto Arnold KIRK & Thomas KIRK my brothers and to Margaret WATERHOUSE & Joan FRITH my sisters every one thirty pounds a piece to be paid one year after my decease and as for the forty pounds which is ten pounds a piece My mind and will is that it be paid yearly according to their birth beginning with the eldest and ending with the youngest . Item I give to Thomas KIRK my nephew son of Arnold KIRK the sum of five pounds. Item I give to Ann BARBER my niece daughter of Arnold KIRK five pounds. Item I give to Mr. CLEGG one guinea. Item I give to John WHITE son of Edward WHITE of Callow two guineas to be paid into the hands of his grandmother Margaret WATERHOUSE. Item I give to Ann BARBER my niece one feather bed, one pair of sheets one bolster  two pillows three blankets one coverlet one pair of purple hangings and two pewter dishes one long plain table cloth and half a dozen plain napkins. Item I give to Henry KIRK my nephew the son of Arnold KIRK all the rest of my household goods as beds, bedding, linen and every thing that I am posest of Item I give all my wearing apparel to my two sisters Margaret WATERHOUSE and Joan FRITH to be equally divided betwixt them Item my mind and will is that when all my debts legacies and fiuneral expenses are discharged the residue and remaining part of my money and everything else undisposed of I give to my nephew Henry KIRK.  Item I do constitute, ordain & appoint my nephew Henry KIRK son of Arnold KIRK of Martinside to be sole executor of this my last will and testament disannulling and making void all former wills by me made.

This is the last Will and Testament of me Isaac LOMAS of Thornilee within Combs Edge in the Parish of Chapel en le Frith in the County of Derby Yeoman made and published in manner and form following, That is to say, First I order and direct all my just debts and funeral and Testamentary charges and expenses to be paid and discharged by my Son Nicholas LOMAS out of my Estate and effects by me hereinafter given devised and bequeathed to him with all convenient speed after my decease Then I give and bequeath unto my Dear Wife Ann LOMAS the feather Bed Bedstead and Bedding thereto belonging now standing and being in my Parlour together with the use of such and so many of my Household goods and furniture as she shall make choice of for the purpose of furnishing her a house for and during the term of her natural life, and an Inventory of the said Household goods and furniture so taken by my said wife shall be made by my Executors hereinafter named and the same to be kept by my said Son Nicholas so that my said wife shall not have power to sell or dispose of all or any part of the said Household goods and furniture but after the decease of my said Wife the same to return unto and be the property of my said Son Nicholas his heirs and assigns forever I also will give and bequeath unto my said Wife during the term of her natural life All that my Messuage or Dwellinghouse with the Croft and Garden thereunto belonging situate and being in Carr Lane within Combs Edge aforesaid now in the occupation of John FRITH as tenant thereof and after her decease I will give devise and bequeath the said Messuage or Dwellinghouse with the said Croft and Garden and other Appurtenances thereunto belonging to my said Son Nicholas LOMAS his heirs and assigns forever I also give and bequeath unto my said wife for and during the term of her natural life One clear Annuity or yearly sum of nine pounds of good and lawful money to be paid to her by two equal half yearly payments the first payment thereof to be made at the end of half a year next after my decease with a proportionable part of such Annuity for any time less than half a year from the time of my death or of any day of payment next proceeding her death and which said Annuity or yearly sum I do hereby charge upon and direct to be issuing and payable out of and from my Estate at Thornelee aforesaid by me hereinafter given devised and bequeathed to my said Son Nicholas LOMAS And I do hereby declare my will and mind to be that if the said Annuity shall be in arrear and unpaid for the space of twenty days next after any half yearly day of payment Then and in such case from time to time it shall and may be lawful to and for my said wife and her Assigns to enter into and upon my said Estate at Thornelee aforesaid or any part thereof and to distrain for the recovery of the said Annuity so in arrear or any part thereof and  all costs charges and expenses attending the same in like manner as in cases of distress for rent in arrear And I do hereby declare my will and mind to be that the provision and the  gifts and bequests hereinbefore given to my said wife shall be in lieu of Power and Thirds and Common Law to all intents and purposes whatsoever I also give and bequeath unto my Daughter Hannah the wife of William BAILEY and to her heirs and assigns the sum of forty pounds to be paid to her by my said Son Nicholas LOMAS one half to be paid to her at the end of twelve months next after by decease and the other twenty pounds the remaining half thereof making together the sum of forty pounds at the end of five years next after my decease I also give devise and bequeath unto my said Son Henry LOMAS the sum of forty pounds to be paid to him by my said Son Nicholas LOMAS in the manner following (that is to say) the sum of twenty pounds one half of the said forty to be paid at the end of two years after my decease and the remaining sum of twenty pounds making together the sum of forty pounds at the end of six years next after my decease And I also give devise and bequeath unto my said Son Henry LOMAS his heirs and assigns forever (subject as follows) All my Messuage or Dwellinghouse with the Blacksmiths shop adjoining thereto and the Croft and Garden called the Clough Green with the Appurtenances situate and being within Combs Edge now in the occupation of James WILSON my tenant a Croft at the lower end of the Smithy and now laid to and being part of the Smithy Croft hereinafter given devised and bequeathed to my said Son Nicholas LOMAS his heirs and assigns for ever (only accepted) But should my said Son Henry die without issue then my will and mind is that the same premises called the Clough Green with the Appurtenances shall be subject to the will of my said Son Nicholas so that the same may stay and continue in my family Or should my said son Nicholas die before my said Son Henry my will and mind is and I hereby direct that my said Son Nicholas shall will the same premises and they shall pass and go by virtue of the same will provided my said Son Henry dies without issue I give and bequeath unto my Grand daughter Ann LOMAS daughter of my late Son Isaac LOMAS ten pounds to be paid to her by my said Son Nicholas LOMAS at the end of three years next after my decease I give and bequeath unto my Grand daughter Ann LOMAS daughter of my late Son Robert LOMAS the sum of five pounds to be paid to her by my said Son Nicholas LOMAS to be paid to her at the end of four years next after my decease And I also give devise and bequeath unto my said Son Nicholas LOMAS his heirs and assigns forever All that that my Messuage and Dwellinghouse with the outbuildings and appurtenances thereunto belonging situate and being at Thornelee aforesaid now in my own occupation subject nevertheless to and charged and chargeable with the payment of the said Annuity to my said wife and also to and with the several Legacies or sums of money by me hereinbefore given to or for my said Daughter and Also Son Henry and Grand daughters at the times and in manner hereinbefore mentioned and appointed for payment therefore respectively  Also I give devise and bequeath unto my said Son Nicholas LOMAS his heirs and assigns forever All that my other Messuage or Dwellinghouse with the Barn Shippons Gardens and Lands with the Appurtenances thereunto belonging situate and being on Carr Green within Combs Edge aforesaid and now in the occupation of Thomas BENNETT as tenant thereof And Also all my Stock of Cattle Implements of husbandry and Household furniture and all other the personal Estate and effects of what nature and kind soever and wheresoever that I may die possessed of  I give and bequeath unto my said Son Nicholas LOMAS his heirs and assigns forever (The furniture hereinbefore given to my said wife during her natural life only accepted) And I do hereby nominate constitute and appoint my said two Sons Nicholas and Henry Executors of this my last Will and Testament and that is shall and maybe lawful to and for my said Executors and the survivor of them his executors or administrators in the first place by and out of the monies and premises respectively which shall come into their hands to deduct and reimburse to himself and themselves all costs charges and expenses as he or they shall expend sustain or be put unto in or about the execution of this my will or of the trusts hereby in them reposed together with a reasonable allowance for their trouble And also I do hereby declare that my said Executors or either of them their or either of their executors or administrators shall not be charged or chargeable with or accountable for more of the aforesaid monies and premises than he or they shall actually receive or shall respectively come into his or their hand or hands by virtue of this my said will nor with or for any loss which shall happen without his or their wilful neglect or default nor the one of them for the other of them or for the Acts deeds receipts payments disbursements or defaults of the other of them And Lastly I do hereby revoke all former and other Will and Wills by me at any time APPEARED PERSONALLY  Nicholas LOMAS and Henry LOMAS both of Combs in the Parish of Chapel en le Frith in the county of Derby Yeoman and farmer Executors named in the last Will and Testament of the said Isaac LOMAS late of Thornley and Combs in the said Parish and in the County of Derby aforesaid Deceased ; and made Oath that the Estate and Effects of the said Deceased, for, or in respect of which a Probate of the said Will is to be granted exclusive of what the said deceased may have been possessed of, or entitled to, as a Trustee for any other person or persons, and not beneficially but including the Leasehold Estate or Estates for years of the Deceased, if any, whether absolute or determinable on Lives, and without deducting any thing on account of  the Debts, due and owing from the said Deceased are under the value of  Three Hundred Pounds to the best of these Deponents knowledge information and belief

In the Name of God Amen I Nicholas LOMAS of Thorney Lee in the Parish of Chapel le Frith and County Derby yeoman being of perfect disposing mind memory and understanding do make and ordain this to be my last will and Testament- First I will that all may Just Debts which I owe to any person or persons at the time of my Decease together with my Funeral Expenses and the Charges attending the Probate of this my will and the Charges attending the Execution of this my will, be paid and discharged out of the profits of my Real Estate by my Executor herein after named-

And as to my Real Estate lyeing and being at Thorney Lee aforesaid in the said parish of chapel-le-frith and County of Derby I give devise and bequeath the same with all the appurtenances thereto belonging to my Nephew Isaac LOMAS son of my Brother Robert LOMAS, to him and to his Heirs for ever, charged and chargeable with Legacies herein after named- I give and bequeath to my Sister Mary DEAN the sum of Three pounds a year to be paid her yearly and every year for and during the Term of her Natural Life, the first payment to be made to her within one year next after my Decease; and I also give to the Children of the said Mary DEAN the sum of Sixty pounds after the Death of their Mother Mary DEAN to be divided amongst them share and share alike And I also give to the said Mary DEAN a certain House and Croft thereto belonging which was bought by my father, and which is situate near to Thorney Lee aforesaid for and during the Term of her natural Life, and then and after her decease I give and bequeath the said House and Croft to my Brother Isaac LOMAS, and to his Heirs and assigns forever.  Also I give to my Nephew Ralph DEAN son of Ralph DEAN the sum of Five Pounds to be paid him within one year next after my Decease.  Also I give to my brother Isaac LOMAS the sum of One Hundred and Twenty Pounds Sterling Money, together with all my Personally which I now have to be paid him within one year next after my Decease.  Also I give to Ellin DIDSBURY wife of John DIDSBURY of Hayfield the sum of Three pounds a year for and during all the Term of her natural Life and I also give the further sum of Sixty Pounds to the surviving children of the said Ellin DIDSBURY to be equally divided amongst them after the decease of their Mother.  Also I give to, Johny MERRIMAN wife of Thomas MERRIMAN of Chelmorton in the Parish of Bakewel and said County of Derby the sum of Three pounds a year yearly and every year, for and during the Term of her natural Life the first payment to be made her within one year next after my Decease; and I also give the further sum of Sixty Pounds to the Children of the said Johny MERRIMAN to be divided equally amongst them after the decease of their Mother.  Also I give to my niece Ann REDDISH the sum of Five Pounds sterling money to be paid her within one year next after my Decease, and I also give to my said niece Ann REDDISH the further sum of Thirty Pounds when she shall attain to the age of Twenty one years.  Also I give to my two nephews Henry and Isaac BAYLEY sons of William BAYLEY The sum of Ten pounds a piece to be paid to each of them when they shall attain to twenty one years of age, and if either of them shall happen to die before they be of Twenty one years of age, then I will that the Ten pounds before bequeathed to be paid to the surviving Brother.  Also I give to my nephew John LOMAS son of my late brother Robert LOMAS the sum of Twenty pounds to be paid him within one year next after my decease.  Also I give to my nephew James LOMAS the Brother of the said John LOMAS the Sum of Twenty pounds to be paid him when he shall be Twenty one years of age.  Also I give to my niece Hannah LOMAS Sister of the said John and James LOMAS the sum of Ten Pounds to be paid her when she shall attain to Twenty one years of age. I also give to my Sisters Sarah DEAN wife of John DEAN half a guinea in gold to be paid her within one year next after my Decease, All which said respective Legacies I will that they be paid out of my Estate at Thorney Lee aforesaid, and I do hereby charge my said Estate therewith – Lastly I constitute and appoint my said brother Isaac LOMAS sole Executor of this my Last will and Testament, trusting he will see to the true and faithful execution thereof In witness whereof I the said Nicholas LOMAS the Testator have to this my last will and Testament set my hand and seal this Fourth day of June in the year of our Lord one thousand seven hundred and sixty Eight

Samuel WATERHOUSE together with the house I now live in and together also with the Cow House and Hay Loft over the same as well as the barn and Old Pig Cote and Coal Hole all now in my own occupation And also the house she now lives in with the Garden and appurtenances thereto subject nevertheless and charged and chargeable with the payment there out by my said daughter Ellen WATERHOUSE and her heirs of the said several Annuities or yearly sums hereinbefore given and bequeathed to my said daughter Betty KIRK my said daughter Maria CRAPPER and my said Granddaughters Ann GREEN and Hannah GREEN making in the whole the sum of sixteen pounds to be paid to them respectively during their natural lives respectively by half yearly payments on every the twenty fourth day of June and twenty fifth day of December The first of such payments to be made on such of the said days as shall happen next after the decease or marriage again of my said wife with power for the said Annuitants respectively  to enter upon the same closes of Land and Premises for recovery of the said annuities respectively if any when in arrear and sell and dispose of such distress as for rent in common demise And from and after the decease or marrying again of my said wife I give and devise all that my small Estate called Moor Top situate in Bugsworth aforesaid and now in the occupation of John WOOD with the Appurtenances unto and equally amongst my seven grandchildren being the children of my late daughter Mary WRIGHT and their heirs for ever And I order and direct that my small plantations and timber trees on my said real estate shall not be fallen or cut down except for needful repairs of my real estate.

And I do hereby declare and direct that the rights shares and interests in my real and personal estates hereby given devised and bequeathed to or in trust for my said Granddaughters and my said Daughters are so given devised and bequeathed to or in trust for them respectively to or for their own sole and separate use and benefit respectively free from the debts control or engagements of any present or future husband or husbands and that the receipts of my said Daughters and Granddaughters respectively for any money to be received by them respectively for or in respect of the same or any of my Trust Estates or any part thereof shall from time to time be good and effectual discharges to my said Trustees or persons paying the same notwithstanding the Coverture of my said Daughters and Granddaughters respectively And I do hereby declare that the receipts or receipt of my said Trustees or the Survivors and Survivor of them or the heirs executors administrators or assigns of such survivor for any money to be paid to them him or her under this my Will shall effectually discharge the person or persons paying the same from being answerable or accountable for any misapplication or nonapplication thereof or any part thereof And I appoint the said Betty KIRK Ellen WATERHOUSE and Samuel WHITEHEAD Executrixes and Executor of this my Will Provided always and I do hereby declare that my said Trustees and Executors and each and every of them and the heirs executors administrators and assigns of each and every of them shall be charged and chargeable respectively for such monies only as they respectively shall actually receive by virtue of the Trusts hereby in them reposed notwithstanding their or any of their giving or signing or joining in giving or signing any receipt or receipts for the sake of conformity and anyone or more of them shall not be answerable or accountable for the others or other of them or for involuntary losses And also that it shall and may be lawful for them respectively with and out of the monies which shall come in their respective hands by virtue of the Trusts aforesaid to retain to and reimburse themselves respectively and also to allow to their respective cotrustees or cotrustee all costs damages and expenses which they or any of them shall sustain expend disburse be at or be put unto in or about the execution of the aforesaid trusts or in relation thereto and also a reasonable sum for their care and trouble respectively in and about the execution thereof And I do hereby declare that if any or either of the said Trustees herein named or any Trustee or Trustee to be appointed or hereinafter mentioned shall die or be anxious of being discharged from or refuse or become incapable to act in the trusts aforesaid then and so often the said Betty KIRK Ellen WATERHOUSE and Samuel WHITEHEAD or the survivors or survivor of them or the executors or administrators of such survivor may by deed appoint any other person or persons to be a Trustee or Trustees in the stead of the Trustee or Trustees so dying or desiring to be discharged or refusing or becoming incapable to act and upon every such appointment as aforesaid the said Trust Premises then vested shall be so transferred that the same may become vested in such new Trustee or Trustees as the case may require and his or their heirs executors administrators and assigns and all and every such new Trustee or Trustees shall either before or after the said Trust Premises shall have become so vested have the same powers authorities and discretions as if he she or they had been hereinbefore appointed a Trustee or Trustees And hereby revoking all former Wills and Codicils by me at any time heretofore made I do declare this only to be my last Will and Testament In witness whereof I the said John LOWE the Testator have to this my Will set and put my hand and seal as follows that is to say my hand to the first five sheets and my hand and seal to this sixth and last sheet thereof the day and year first before written.

In the name of God Amen, I Joseph LOWE of Hollinwood within Bugsworth in the Parish of Glossop and County of Derby yeoman being in health of Body and of sound mind and memory and understanding praised be God for the same do make publish and declare this to be my last Will and Testament in manner and form following that is to say First I will and desire that I may be decently interred and that all my just Debts and funeral expences and probate and execution of this my Will be paid and discharged out of my personal Estate, but should it be found insufficient to discharge the same and other bequests hereinafter mentioned, the deficiency to be raised from the rents and profits of the Hollinwood Estate by my Executors hereinafter named.  Then I Give devise and bequeath unto my son Samuel LOWE his Heirs and Assigns for ever.  All that Messuage Farm Lands and outbuildings with the Hereditaments and Appurtenances thereunto belonging commonly called and known by the name of Roeside Estate - and a piece of Land called the piece lying near Stonyford Clough all which said premises are situate in the Parish of Chapel en le Frith and County of Derby aforesaid and now in the Tenure or occupation of Ralph TURNER.  Also I Give and bequeath unto my sister Elizabeth HEATHCOTT one Annuity or clear yearly sum of ten pounds during her Life payable and issuing out of the said farm called Roeside the same to be paid by two half yearly Payments the first of the said payments to begin either on the twenty second day of June or on the twenty seconday (sic) day of December which happens first next after my Decease.  I also Give and devise unto Samuel HANDFORD William WILLOTT and George HEATHCOTT my Executors hereinafter named their Executors Administrators and Assigns All that my Estate called Hollinwood Estate in Bugsworth aforesaid and also all my personal Estate of what nature soever and wheresoever with the rents issues and Profits of all and singular the said premises In Trust nevertheless and to the intent and purpose hereinafter mentioned that they convert all my personal Estate into money immediately after my decease (some furniture hereinafter given to my wife only excepted) and out of the money arising therefrom to pay as hereinbefore and hereinafter mentioned.  And to my wife Ann LOWE I Give and bequeath one Annuity or clear yearly sum of twenty five pounds to be paid to her at the time and in manner before stated the twenty second day of June and the twenty second day of December so long as she remains single and also a Dwellinghouse situate at the South East End of my Dwellinghouse but if she marries again my will and mind is she shall have five pounds a year payable as aforesaid which said Annuity of either twenty five pounds or five pounds shall be payable out of the rents issues and profits of my Estate called Hollinwood and the before mentioned annuity I Give to my said wife in lieu of Dower and Thirds at Common Law And also I Give to her one Bed complete one Chest and all other necessary furniture fit and convenient to furnish a Room at the discretion of my said Executors while she continues single or during her natural Life and then the same to be divided equally share and share alike amongst my Son Samuel LOWE`s Children.  Also I Give and bequeath unto my Servant Man Peter LOWE the sum of twenty pounds.  Also I Give and bequeath all my wearing Apparel unto my Brother James LOWE and my Brother Peter LOWE`s Sons to be equally divided share and share alike amongst them.

Also my will and mind is that my said Executors shall set (sic) the said Hollinwood Estate as soon after my decease as may be convenient, for the best price that can be obtained at the time to pay the said annuity Legacy and Debts should my other personal Estate and effects be insufficient And if my said wife happened to marry again, or otherwise after her decease my said Executors shall sell sell (sic) the said Hollinwood Estate and the Timber then growing thereon by Auction, and the House before given to my said wife for Life either together or separate as my said Executors shall think most condusive, for the best price or prices that may be got for the same and out of the monies to arise by such sale I Give and bequeath the sum of three hundred pounds unto Edward SHARPLEY of Ranow in the Parish of Prestbury in the County of Chester yeoman his Heirs and assigns but before the above sum be paid my said Executors must receive a Note of the sum of one hundred and ten pounds which the said Edward SHARPLEY holds against me And the rest residue and remainder of the said purchase money and effects I Give and bequeath unto the children of my Brothers and Sisters James Peter Elizabeth and Ann share and share alike.  Also my will and mind is that should my said son Samuel wish to either sell or Mortgage the said Roeside Estate my said Executors or the Survivor or Survivors of them his or their Executors shall be acquainted with the necessity of so doing, and if they find it prudent for him to either sell or Mortgage, they shall be made a party to the Deed or Deeds and no Conveyance or Mortgage shall be effectual and valid in law during the Life of my said Son, Unless my said Executors or the Survivor or Survivors of them his or their Executors be made a party to the said Conveyance or Mortgage

This is the last will and testament of me Samuel LOWE of Roeside In the parish of Chapel-en-le-Frith and County of Derby Yeoman.  I direct the payment of all my just debts funeral expenses and testamentary expenses out of my personal estate but if that shall prove insufficient the deficiency to be paid out of my real estate. I nominate constitute and appoint my wife Hannah and my daughters Elizabeth WILLIAMSON, Martha GODDARD, Hannah LOWE, Mary WILLIAMSON, Ann LOMAS, Rachel MIDDLETON and Leah LOWE executrixes of this my will and testament. As soon as convenient after my death I order and direct that the whole of my personal property be sold by public auction and the money arising from such sale after the payment of my just debts funeral and testamentary expenses be paid to my said wife Hannah LOWE towards maintaining her till such time as her annuity hereinafter mentioned becomes due.  After my death I order and direct that my executrixes let the Roeside estate and Stoneyford Piece at a fair rent and keep the same in good and tenantable repair. I then give devise and bequeath to my wife Hannah out of the rents of the Roeside estate and Stoneyford Piece an annuity or clear yearly income of thirty pounds a year to be paid to her by half yearly instalments on the first day of June and the first day of December yearly And the first instalment to be due on the first of the aforesaid days which shall happen after my decease. And the remainder of the rent from the Roeside Estate and the Stoneyford Piece after the payment of the aforesaid annuity to my said wife I leave equally or share and share alike amongst the whole of my children or the children of such of them as may be dead such child or children representing their respective parent or parents only. After the death of my said wife I order and direct that my executrixes or the survivors of them sell the Roeside estate for the best price that can reasonably had or obtained and that the money arising from such sale be divided equally amongst my said daughters or the children of such of them as may be dead such children representing their respective parent only with the exception of my daughter Leah to whom I leave £250 less than to the remainder of her sisters but after the payment of £250 to each of her sisters or to their children she is then to come into an equal share with her sisters of the money arising from the sale of the Roeside estate. And after the death of my said wife in place of the £250 before mentioned I give devise and bequeath to my daughter Leah her heirs and assigns for ever one field or close of land called or known by the name of Stanniford Piece situate lying and being in Bowden Edge and now in the occupation of William JOWLE But in case my said daughter Leah dies before my said wife I order and direct that Stanniford Piece be sold by my executrixes and divided equally amongst them my surviving daughters or the children of such of them as may be dead such children representing their respective parent only.  But in case my said daughter Leah die before my said wife leaving child or children then I order and direct that such child or children take one share equal to the remainder of any one of my daughters of the money arising from the Roeside estate and the Stoneyford Piece  It is my will and mind and I order and direct that the signature of my executrixes or the survivors of them shall be sufficient to any deed or conveyance and assuring such property as has to be sold by virtue of this my will. And I order and direct that the purchaser or purchasers of such property as may have to be sold by virtue of my will shall not be answerable for the application or non application of their respective purchase money. And that the receipt of my executrixes or the survivors of them shall be sufficient discharge to such purchaser or purchasers In case any of my said daughters die before me or my said wife leaving issue I do nominate constitute and appoint Martha GODDARD and Hannah LOWE trustees to the children of such of my daughters as may be dead and I do order and direct that the said Martha GODDARD and Hannah LOWE or the survivor of them shall receive the share or shares of the children of such of my daughters as may be dead and invest the same on good and proper security and apply the interest arising therefrom for the education and bringing up of such grandchildren till they shall respectively attain the age of 21 years. And further it is my will and mind and I order and direct that as my said grandchildren attain the age of 21 years they shall respectively receive such share or shares as may fall to them by virtue of this my will and I do declare this to be my last will and testament  In witness whereof I have hereunto set my hand and seal in due course of law this nineteenth day of June one thousand eight hundred and forty eight

In the name of God Amen,  I Thomas MIDDLETON of the Parish of Chapel  in  le Frith and in the countie of Derby, Grocer, being of sound mind and memory Blessed be God for it.  Do make  publish and declare this my last will and testament in manner and form following.  To Wit.

First I give and bequeath to my loving wife Elizabeth MIDDLETON The house I now live in with William SHEPLEY’s house and Will’m BARRATS house with all the buildings and premises thereunto belonging and all the household goods in my house now standing to her own use and behalf during the term of her natural life.   I likewise give and bequeath to my wife the profits and benefits of the farmhouse I now hold under Mr & Mrs WINGFIELD during the remainder of the term I have in the lease, she paying the rent charged upon it during the term.

I give and bequeath to my dear daughter Ann MIDDLETON the sum of five hundred pounds

I give and bequeath to my dear son Robert the sum of eight pounds a year to be paid him yearly and every year during the term of his natural life by two half yearly payments.    Payment to be made within 4 months after his arrival in England.

I give and bequeath to my dear son Thomas MIDDLETON all my right, title and benefit to the estate left to me by my late uncle Thomas HEGINBOTTOM situate in Droylesden in Lancashire to him his heirs and assigns for ever.

I likewise devise and bequeath to my said son Thomas MIDDLETON the house I now live in with all the buildings and premises thereunto belonging after the decease of his mother with Wm SHEPLEYs house and William BARRATs house with all the right and title to the premises I now hold in Chapel in le Frith to him his heirs and assigns forever.

And all the rest residue and remainder of my wordly goods and effects whatsoever and likewise what other rights and title I may have in expection of any estate and effects to fall to me hereafter I give devise and bequeath to my dear son Thomas MIDDLETON his heirs and assigns for ever. In the name of God Amen I Edward VERNON late of Smalldale in the liberty of Peak Forest, but now of Eaves in the parish of Chapel-en-le-Frith and County of Derby yeoman being far advanced in years but of perfect mind and memory thanks be to God do make and ordain this my last will and testament in manner and form following. First I commend my soul into the hands of almighty God in whom I trust to be saved and my body I commit to the earth to be decently buried at the discretion of my executors herein after named and as touching such worldly goods and enjoyment as it hath pleased Almighty God to bestow upon me I give and dispose of the same as follows.  First I give devise and bequeath unto my two Granddaughters Elizabeth and Maria DAVENPORT all that my estate lying and being in Chinley in the parish of Glossop and County of Derby and commonly called or known by the name of Southhead and now in the tenure holding or occupation of William BROADHURST together with all and singular woods ways lanes and passages heraditaments and appurtenances whatsoever to the said land and premises belonging or in any wise appertaining unto my said two granddaughters Elizabeth and Maria DAVENPORT equally between them share and share alike and to their heirs for ever when they shall attain the age of twenty one years.  And during the time of their minority the rents and profits arising from the said estate shall be for their maintenance and it is my will and mind that the said estate shall not be sold or disposed of without the mutual consent of each other But if it happeneth that either of them die leaving no issue then I give and bequeath the said estate unto the survivor and her heirs for ever on condition that she pay or cause to be paid unto my daughter Mary KIRK the sum of one hundred pounds at the expiration of one year after the death of her sister and in case they both die leaving no issue then I give and bequeath one half of the said estate unto my daughter Mary KIRK for all her uses and purposes and the other half I give to my Granddaughters being daughters of my said daughter Mary KIRK by her present husband Henry KIRK equally amongst them share and share alike to them and their heirs for ever But if my daughter Mary KIRK should die before my Granddaughters Elizabeth and Maria DAVENPORT and both my said granddaughters Elizabeth and Maria DAVENPORT should afterwards die and leaving no issue then half of the estate before mentioned and intended to be given to my daughter Mary KIRK shall be equally divided amongst all my surviving grandchildren share and share alike and if any of them should die leaving no issue then the share of the deceased shall be equally farm situated at Smalldale in the liberty of Peak Forest aforesaid and rented under His Grace the Duke of Devonshire and likewise all my personal estate upon the following condition that is to say that after paying all my just debts and funeral expenses and charges he shall pay unto my daughter Mary KIRK the sum of one hundred pound at the expiration of one year after my decease and also the sum of eight hundred pounds to be equally divided amongst my grandchildren which are the children of the aforesaid Henry KIRK by his present wife the oldest son being excepted and the before mentioned legacies shall be paid them as they respectively attain the age of twenty one years and if any of them happen to die leaving no issue then the share of the deceased shall be equally divided amongst the survivors but in case they should all die without issue then one half of the before mentioned eight hundred pounds shall be given unto my grandson being a son of my daughter Mary by her present All the residue and remainder of my personal estate and effects of what nature or kindsoever and wheresoever being I give and bequeath unto my friend Edward POTTS of Upper end within Wormhill in the said County, Farmer, and Joseph WAINWRIGHT of Tunstead within Wormhill aforesaid Farmer their executors, administrators and assigns Upon trust to collect and convert the same into money and do and shall thereout pay my debts, funeral and testamentary expenses and subject thereto to place the same out at Interest upon good security and pay and apply the yearly interest and annual produce thereof to or otherwise permit the same to be received by my said wife during her life to or for her own use and after the decease of my said wife I give and bequeath the same trust monies unto and equally among all and every the children of my late Sister Hannah BENNETT deceased wife of John BENNETT late of Fernilee in the said County, Yeoman, also deceased who shall be living at the time of my said Wife’s decease and to the issue of such of them as shall be then dead leaving issue equally share and share alike (except John BENNETT the eldest Son of my said Sister and his issue) such issue of her other children nevertheless to have and take the part and share on which his her or their parent or parents would if living have been entitled to I devise all mortgaged and trust estates which may be vested in me unto the said Edward POTTS and Joseph WAINWRIGHT their heir executors, administrators and assigns subject to and upon the equities and trusts affecting the same I nominate and appoint the said Edward POTTS and Joseph WAINWRIGHT Executors of this Will. And I declare that the receipt and receipts of my said trustees and Executors and each of them their and each of their heir executors, administrators or assigns for any sum or sums of money payable to them or him under or by virtue of this my Will shall be sufficient discharge for so much money as in such receipt or receipts shall be expressed and acknowledged to be received. And also that my said trustees and Executors shall not be answerable the one for the other or for the acts deeds or defaults of the other of them nor for the insufficiency or deficiency of any security nor for involuntary loss nor for money received under receipts in which they shall join only for conformity and that they and each of them shall and may reimburse themselves and himself out of the said trust monies or out of any monies that may come to their hands by virtue of this my Will all costs, charges and expenses to be incurred by them in the execution of the trusts aforesaid or in anywise in relation to this my Will together with a reasonable allowance for journies, loss of time and trouble in or about the same. And in all other respects I do hereby ratify and confirm my said Will. Husband to Margaret Kyrke of Martinside

In the name of God Amen I John WATERHOUSE of Heafield in the County of Derby Yeoman do ordain and make this my last will and testament as follows. Imprimis I give and bequeath unto Margaret my loving wife as an (ad ?missing) to her jointure that messuage & parcel of land which I purchased lately of Guy ROLLINSON of Hygate called by the names of the botham, the doobank & the roode which she is to enjoy whilst continuing in my name & no longer & twenty pounds in money which if she please she may have what sort of goods pleaseth ( missing) 

Item I give & bequeath unto my daughter Ann (if it please the almighty to give me a son born in due time after my decease) four hundred pounds and an hundred pounds more to be given to her by such son  but if it please the almighty to give me another daughter then my will and mind is that after all my due debts and funeral expenses be discharged my two daughters shall have the rest of my estate divided betwixt them and after my wife’s decease her jointure also.   Item I give unto my honoured father ten pounds & also a competent maintenance during his life & a decent interment at his death. Will of Margaret Waterhouse nee Kyrke: 1767

In the name of God Amen I Margaret WATERHOUSE of Slack Hall in the parish of Chapel-en-le-Frith and County of Derby widow being something indisposed as to my bodily health but of sound and disposing memory praised be God for it . For the preventing of lawsuits and differences amongst my children, my relations and friends at after my decease do make and declare this my last and testament in manner and form following.  First I recommend my soul into the hands of God and my saviour Jesus Christ in hopes of a joyful resurrection my body I also recommend to a decent interment according to the discretion of my executors hereafter named.  And as touching the disposition of such worldly estate and effects as it hath pleased God of his goodness to bestow upon me and bless me with I dispose of the same as follows. 

That is to say my will and mind is that my executors hereafter named shall pay and discharge all my just debts funeral expenses and the charges of probate of this my last will and testament together with all reasonable charges and expenses that my exors. Hereafter named shall pay or lay out in executing and fulfilling the trust of their executorship out of my personal estate. 

Item. I give to my daughter Anne SLACK my chest during her natural life and after my said daughter Anne SLACK’s death I give my said chest to my granddaughter Margaret BIRCH

Item I give all the remainder of my household goods and furniture together with all my clothes wearing apparel beds and bedding with all my linens and books to my two daughters Anne SLACK and Mary WHITE to be equally divided between them share and share alike. (reserving power to my execs hereafter named for them to sell and dispose of so many of my household goods and furniture beds and bedding as shall make up the deficiency if any there be of my ready money paying my funeral expenses and charges of the probate of this my last will and the expenses which my execs. Hereafter named shall be put unto concerning the same.  Item my will and mind is and I do hereby order and direct that my exors. Hereafter named shall receive take and have all the remainder of money that is justly due and owing to me from any person or persons whatsoever upon bond or bonds note or notes or by book debts or by any other ways whatsoever all which remainder of my said money my will and mind is and I do hereby order and direct that my exors. Hereafter named shall pay and dispose of the same in manner and form following.  That is to say my will and mind is that my exors. Shall pay unto my two daughters Anne SLACK and Mary WHITE all the interest or income that shall arise accrue or become due for the remainder of the said money yearly which interest is to be paid to them yearly during their natural life and lives and to be equally divided between them share and share alike But if it shall happen that my daughter Anne SLACK shall died and not leave any child or children lawfully begotten on her body and that shall be living at the time of her death I give such share or moiety of the remainder of my said money as was given to my daughter Anne SLACK for her life to my grandson John WHITE He my said grandson John WHITE paying unto my granddaughter Margaret BIRCH the clear yearly sum of one pound and eight shillings of good and lawful money of Great Britain during her natural life out of such share or moiety of the remainder as was given to my daughter Anne SLACK for her life. And if it happen that my granddaughter Margaret BIRCH shall leave one or more children lawfully begotten on her body at the time of her death and that such child or children shall live to attain the age or ages of twenty one years my will and mind is and I do hereby order and direct that my said grandson John WHITE shall give to and amongst such of my said granddaughter Margaret BIRCH her children the sum of thirty five pounds of good and lawful money of Great Britain and to be paid to such child or children as they shall separately attain the age or ages of twenty one years share and share alike out of such remainder of my money as my daughter Anne Slack received the interest of one moiety of during her life BUT if it shall happen that my granddaughter Margaret BIRCH shall die and not leave any child or children lawfully begotten on her body which shall attain the age of twenty one years my will and mind is and I do hereby give the above mentioned thirty pounds to my grandson John WHITE to be disposed of to and amongst his children as they shall attain the age and ages of twenty one years share and share alike. And as for and concerning the disposition of the other share or moiety of the remainder of my money herein before given to my daughter Mary WHITE for her life after Mary WHITEs death I give such share or moiety of the remainder of my money as was given to my daughter Mary WHITE to receive the interest of for her life. And if is shall happen that my granddaughter Margaret BIRCH shall die and leave one or more child or children lawfully begotten on her body living at the time of her death and that such child or children shall live to attain the age of twenty one years my will and mind is and I do hereby order and direct that my said grandson John WHITE shall give to and amongst such of my granddaughter Margaret BIRCH her children the sum of thirty five pounds of good and lawful money of Great Britain and to be paid to such child or children as it or they shall attain the age of twenty one years share and share alike out of such remainder of my money as my daughter Mary WHITE received the interest of one moiety during her natural life BUT if my granddaughter Margaret BIRCH shall happen to die and not leave any child or children lawfully begotten on her body which shall attain the age of twenty one years my will and mind is and I do hereby give the above mentioned thirty five pounds to my grandson John WHITE to be disposed of by him to and amongst his children as they shall attain the age of twenty one years share and share alike. ITEM as for all the rest residue and remainder of my money which is not herein before by me given and disposed of I give it all to my grandson John WHITE to be disposed of by him to an amongst his children as they shall attain the age and ages of twenty one years share and share alike. Item my further will and mind is and I do hereby order and direct that if any of my relations or legatees herein before mentioned shall be discontented or uneasy with the provision by me made for her or them and shall raise or commence any law suit action or actions as law against my executor or executors or one legatee against another legatee that in every such case or cases all and every such legatee or legatees who shall prove so litigious or troublesome shall thereby forfeit and lose all of her or his share and shares of all my said money goods and effects and personally hereby before by me given and bequeathed to her or him or them respectively and in lieu thereof shall have one shilling a piece out of it and no more.  And lastly I do hereby nominate constitute and appoint my grandson John WHITE, my nephew Henry KYRKE of Martinside and my nephew Peter STEEL of Bagshawe (otherwise Silk Hill) executors of this my last will and testament hoping they will faithfully perform the trust which I do hereby repose in them And I do hereby revoke and utterly make void all former and other will or wills testament and testaments by me heretofore made and I have hereunto put my hand and seal this second day of January one thousand seven hundred and sixty seven
